Entries will be judged on or about 11/30/06 by the Administrator, whose decisions and interpretations on all matters relating to the Contest and these Official Rules are final and binding in all respects. Contestants will be judged based on the following criteria: Relevance to theme, creativity, overall quality and thoroughness of work . All entries submitted become the property of the Administrator and none will be acknowledged or returned. Potential winners will be notified by telephone or email on or by December 2, 2006, and must meet all eligibility requirements. Return of prize notification as undeliverable, or inability of Administrator to contact a potential winner by telephone or e-mail within seventy-two (72) hours of selection, may result in disqualification of such potential winner, and an alternate winner may be selected at Administrator's discretion. In the event a potential winner declines a prize or fails to return any completed documents and releases as required, Administrator may elect, at its discretion, to award prize to the next highest scoring entrant. LIMITATIONS OF LIABILITY & RELEASE: By participating in the Contest, contestants agree, and by accepting prize, winners agree, to indemnify and hold harmless the Sponsor, the Administrator and their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively, “Releasees”) from and against any and all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the Contest, or acceptance, possession, use, misuse, or nonuse of the Prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. Releasees are not responsible for printing or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible entries; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly, or are lost for any reason, including, without limitation, computer, telephone, paper transfer, or human error; or for electronic, computer, or telephonic malfunction or error. If, in the Administrator's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if a computer virus, bug, unauthorized intervention, fraud, technical difficulties, or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, Administrator reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to void any entries submitted fraudulently; to modify or suspend the Contest; or to terminate the Contest and judge all non-suspect entries received as of the termination date to select winners. If the Contest is cancelled, modified, suspended or terminated, a notice will be posted on the website. PUBLICITY, PRIVACY & PRIZE NOTIFICATION: Except where prohibited by law or regulation, by submitting an entry, Contestants grant the Administrator a perpetual, worldwide, royalty-free license to use his/her name, character, photograph, voice, and likeness in connection with the promotion of this and other Contests, and contestants waive any and all claims and/or rights to receive any royalties or other compensation for the Administrator's use thereof, unless prohibited by law. Contestants agree that the Administrator may disclose to third parties all personal information obtained from Contestants and use such information for marketing and other purposes. Winners will be required to complete, sign, notarize and return an affidavit of eligibility/liability release and a publicity release, which must be returned, properly executed, within seven (7) days of issuance of Prize notification. If these documents are not returned properly executed, or are returned to Administrator as undeliverable, or if any given Prize Winner does not otherwise comply with the Official Rules, the Prize will be forfeited and may be awarded to an alternate winner. There will be only one (1) prize per winner. The prize may not be transferred under any circumstances. Only the listed Prizes will be awarded and no substitution, cash equivalents or redemption will be made, except that Administrator reserves the right to award a prize of equal or greater financial value if the advertised prize (or any component thereof) becomes unavailable. Prizes cannot be used in conjunction with any other promotion or offer. The winner agrees to accept the prizes “as is”, and contestants hereby acknowledge that Administrator has neither made nor are in any manner responsible or liable for any warrant, representation, or guarantee, express or implied, in the fact or in law, relative to the Prizes, including express warranties (if any) provided exclusively by the Prize suppliers that are sent along with the Prizes. Any valuation of the Prizes stated above is based on available information provided to the Administrator and the value of the Prizes awarded to the winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes. Winner must provide Administrator with a valid taxpayer identification number or social security number before any prizes will be awarded. |
